Qualifying Criteria

Admission of the Applicant as a Supplier will be subject to the following qualifying criteria (Qualifying Criteria):

1. the Applicant must establish that it holds all regulatory approvals required to supply the applicable Aviation Fuel;
2. The Applicant must:
   1. be able to deliver Aviation Fuels to the JFI Facility, to be supplied through the JFI Facility, sufficient to supply its Customers' requirements in full and which meet the Aviation Fuel Specifications; and
   2. have access to a National Association of Testing Authorities approved laboratory testing facilities consistently and promptly to confirm such quality;
3. the Applicant must demonstrate that it:
   1. adheres to JIG requirements and standards;
   2. is at all times capable of fulfilling the obligations of a Supplier under the Terms of Use including the financial requirements relating to Aircraft Refuelling liability;
   3. is technically able and has sufficient resources to be able to comply with the operating procedures and standards set out in the Terms of Use;
   4. ongoing compliance with EI1530 requirements, including provision of inspection reports and certification, from time to time; and
   5. has insurance coverage or financial resources which is adequate to meet its obligations under the Terms of Use; and
4. the Applicant must provide written confirmation to Perth Airport that:
   1. it will enter into the User Agreement;
   2. it will enter into the Tarbox Indemnification Agreement;
   3. it (or its Customers) has appointed (or will appoint before becoming an active supplier of Aviation Fuel through the JFI Facility), and provide Perth Airport with the name(s) of, an ITP Service Supplier to service its Customers and, where required by Perth Airport each such ITP Service Supplier has entered into or will enter into an ITP Access Agreement with Perth Airport;
   4. it has (or will have before becoming an active supplier of Aviation Fuel through the JFI Facility) a written contract or other form of binding commitment with one or more Customers to supply Aviation Fuel into-plane fuelling services to such Customers at the Airport; and
5. any other qualifying criteria for Suppliers specified in writing by Perth Airport from time to time.

Notwithstanding an Applicant's satisfaction of the Qualifying Criteria, Perth Airport may, in its absolute discretion, reject any application on written notice to the Applicant.

Definitions

Applicant means any person desiring to supply Aviation Fuel through the JFI Facility.

Security means financial security in the form and amount as notified by Perth Airport to the Applicant from time to time.

Tarbox Indemnification Agreement means a tarbox indemnification agreement in the form provided by Perth Airport.

Terms of Use means the JFI Terms of Use provided by Perth Airport to the Applicant.
